Role overview

General Objective: 

The over-all objective of this mission is to conduct an institutional review and assessment of the Shari’ah Justice System as envisioned in the Judiciary’s Strategic Plan for Judicial Innovations 2022-2027.

Specific Objectives: 

  1. Conduct a review of the overall performance of the Shari’ah Justice System including an assessment of the administrative structure and operating systems context in the Judiciary in which the Shari’ah courts operate.
  2. Identify the strengths and weaknesses in the various aspects of the Shari’ah justice system that promote or hinder their efficiency and/or effectiveness and responsiveness, especially as it impacts the poor and marginalised, such as women, people with disabilities, living in geographical isolated and disadvantaged areas (GIDA) or in Moro diaspora communities, among others.
  3. Examine the societal and cultural contexts (internal environment) as well as identify the opportunities and threats (external environment) that affect the functioning of a sound Shari’ah system.
  4. Asses the jurisdiction of Shari’ah courts, to include both criminal and commercial cases, the creation of additional Shari’ah courts outside the BARMM and the implications on the current Shari’ah courts within the BARMM, and the feasibility of organising the Shari’ah High Court under Article X, Section 7 of Republic Act 11054.
  5. In relation to number 4 above, to recommend amendments to Batas Pambansa 129 (An Act Reorganising the Judiciary) as it relates to the Shari’ah Courts.
  6. Assess the qualifications for appointment to Shari’ah District and Circuit Courts and eligibility to practice before Shari’ah courts, including the training/competencies required for Shari’ah judges and practitioners.

  • Fluent in spoken and written English
  • Knowledge of Arabic and other local BARMM languages is preferred
  • Excellent research and analytical competence, and detail oriented
  • Can work effectively in a team organisational environment
  • Excellent interpersonal skills
  • Active listening skills and strong writing skills
  • Excellent ability to coordinate and communicate with key stakeholders

Qualifications:

  • Degree in Statistics, Mathematics, Economics, Social Science, or other relevant degrees or equivalent in experience
  • Proven skills in data analytics
  • Proven skills in the development of survey instruments and interpretation of survey results

General Professional Experience:

  • Minimum of 5 years of relevant professional experience in the private or public sector
  • Proven knowledge of the justice sector, especially the judiciary with sufficient familiarity and knowledge of the general nature of the judiciary as an institution preferred
  • Experience in supporting the introduction and communication of key policy reforms in any private corporation and/or governmental agencies

Specific Professional Experience:

  • Extensive work experience and proven professional record in data analytics, including HR analytics
  • Proven knowledge, experience, and familiarity with organisational development and change management
